Terms of Service

The short version: Use Tappa responsibly and lawfully. Your profile content is yours. Subscriptions are in Naira and renew automatically until cancelled. We handle your data under the NDPR and GDPR (see our Privacy Policy). These Terms are governed by Nigerian law.

1. Acceptance of terms

By downloading, installing, or using the Tappa mobile application or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Tappa ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to create a Tappa account. If you are below the age of digital consent that applies in your country (but at least 13), you may use Tappa only with the verifiable consent of a parent or guardian. We do not knowingly permit children under 13 to use the Service.

By using the Service, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms. If you are using Tappa on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

3. Account registration

To access most features of Tappa, you must create an account. You agree to: • Provide accurate, current, and complete information during registration. • Maintain the security of your password and account credentials. • Notify us immediately at fixit@tappa.me if you suspect unauthorised access to your account. • Accept responsibility for all activity that occurs under your account.

We reserve the right to terminate accounts that we determine, in our sole discretion, are in violation of these Terms.

4. Acceptable use

You agree not to use the Service to: • Upload or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable. • Impersonate any person or entity, or falsely represent your affiliation with any person or entity. • Spam other users or distribute unsolicited commercial messages. • Interfere with or disrupt the integrity or performance of the Service. • Attempt to gain unauthorised access to any part of the Service or its related systems. • Harvest or scrape profile data from the Service in bulk. • Use the Service for any fraudulent, deceptive, or misleading purposes. • Violate any applicable local, national, or international law or regulation.

We reserve the right to suspend or terminate your account for any violation of these restrictions, without prior notice.

5. Public profiles

When you create a Tappa profile, you choose which information to make publicly accessible via your profile URL (tappa.me/yourusername). You are solely responsible for the content of your public profile.

By creating a public profile, you grant Tappa a non-exclusive, worldwide, royalty-free licence to display your profile content as part of the Service. This licence is revocable at any time by deleting the relevant content or your account.

You agree that your public profile will not contain content that violates these Terms or any applicable law.

6. NFC device usage

Tappa enables you to write data to NFC tags, cards, rings, and other NFC-enabled devices. You are responsible for any NFC device you programme using the Service and for how that device is used.

You agree not to programme NFC devices with content that is illegal, deceptive, or harmful. Tappa is not responsible for any physical NFC device you purchase or use in connection with the Service.

7. Subscriptions and billing

Tappa offers a free tier and a paid Pro subscription, priced in Nigerian Naira (₦). Depending on where you subscribe, payments are processed by Paystack (on the web and for hardware orders) or by the Apple App Store (iOS) or Google Play Store (Android). By subscribing, you agree to the billing terms of the relevant provider.

Free trial: If a free trial is offered, it will be clearly communicated before you subscribe. Your subscription begins at the end of the trial period unless you cancel beforehand.

Recurring billing: Pro subscriptions renew automatically at the end of each billing period (monthly or annual) until cancelled.

Cancellation: You may cancel at any time. For app-store subscriptions, cancel through your App Store or Google Play account settings; for web subscriptions, manage or cancel from your Tappa account. Cancellation takes effect at the end of the current billing period; you retain access to Pro features until then.

Refunds: We do not offer refunds for partial subscription periods. Refund requests for exceptional circumstances may be submitted to fixit@tappa.me. Refunds for App Store purchases are subject to Apple's refund policy; Google Play purchases are subject to Google's refund policy; Paystack payments are handled in line with our refund practices and applicable consumer law.

Price changes: We may change subscription prices with at least 30 days' notice. Continued use of the Pro subscription after the price change takes effect constitutes acceptance of the new price.

8. Intellectual property

All intellectual property rights in the Service, including the Tappa name, logo, app design, and underlying technology, are owned by or licensed to us. These rights are reserved.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content, nor may you reverse engineer or attempt to extract the source code of the app, except as permitted by applicable law.

Content you create and upload (your profile photo, social links, etc.) remains yours. You grant us the licence described in Section 5 to display it as part of the Service.

9. Data protection and privacy

Your privacy matters to us. Our collection and use of personal data is governed by our Privacy Policy (tappa.me/privacy), which forms part of these Terms.

We process personal data in accordance with the Nigeria Data Protection Act 2023, the Nigeria Data Protection Regulation 2019 (NDPR), and, where applicable, the EU and UK General Data Protection Regulation (GDPR). You have rights over your personal data, including the rights to access, correct, export, and delete it, as described in the Privacy Policy. By using the Service, you acknowledge that you have read the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: • The Service will be uninterrupted, error-free, or secure. • NFC writing or reading will work on all devices or with all NFC hardware. • Profile views or tap analytics will be 100% accurate.

Nothing in these Terms excludes or limits any rights you have under mandatory consumer protection law that cannot lawfully be excluded.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPPA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₦50,000, WHICHEVER IS GREATER. This limitation does not apply to liability that cannot be excluded or limited under applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if we discontinue the Service.

You may terminate your account at any time by deleting it within the Tappa app. Upon termination, your profile and data will be deleted in accordance with our Privacy Policy.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the jurisdiction of the competent courts of Nigeria.

If you are a consumer resident in the European Union or United Kingdom, you may also benefit from any mandatory provisions of the consumer protection law of your country of residence, and nothing in these Terms affects those rights.
